RULE:  34-095
ISSUED:  August 15, 2000 EFFECTIVE:  September 01, 2000
SUBJECT:  UNLOADING INTO/LOADING FROM THE ELEVATOR

The Elevator Management reserves the right to refuse any agricultural commodities, which in its opinion is unmerchantable or in a condition not suitable for storage, transfer, or handling.  The primary purpose of the Elevator is to facilitate the import and export of agricultural commodities by providing the service of loading and/or unloading/discharging of such commodities from/to railcars, trucks, and water conveyances.  Storage in the Elevator is only for the positioning/consolidating of such commodities for immediate/impending vessel execution.  Therefore, management reserves the right to preferentially unload those railcars and/or trucks for which outward shipping space has been engaged and is available for loading.  The Elevator is not intended for long-term (defined as over 45 days) storage without prior written approval of Management.  In the event any commodities remain in store after 45 days, management reserves the right to remove such, without prior notice, to prevent or alleviate congestion.  All expenses for such removal shall be for the account of the owner.

In furnishing the services provided for herein, the Facility assumes no responsibility whatsoever for demurrage or additional switching on railcars, or detention on trucks. 

Customers and agents must receive advance approval in writing via fax or e-mail from the facility logistics department prior to ordering any agricultural commodity to be unloaded or loaded.
