ISSUED:  December 07, 2010 EFFECTIVE:  January 15, 2011
SUBJECT:  VESSELS REQUIRED TO VACATE BERTH
Should any vessel fail to vacate the berth when ordered to do so by the facility management, a penalty charge of $1,075.00 per hour for each hour or fraction thereof will be assessed against the vessel and/or its owner and agents after Notice to Vacate has been given to the vessel and/or its owners, agents master or mate.  This charge shall not affect the right of the elevator to remove the vessel from the berth by any lawful means, at vessel's risk and expense.
